DeSantis wrote, "Congress has the authority to strip jurisdiction of the federal courts to decide these cases in the first place. The sabotaging of President Trump’s agenda by ‘resistance’ judges was predictable — why no jurisdiction-stripping bills tee’d up at the onset of this Congress?”
When asked how such a measure could survive the Senate’s 60-vote requirement, DeSantis replied with a simple workaround: "Attach it to a ‘must-pass’ bill." Well, that’s one way to play political hardball!
DeSantis, who sought the 2024 Republican presidential nomination but withdrew after the Iowa caucus to support Trump, raised this idea in response to a tweet by U.S. Representative Chip Roy of Texas. Roy had floated suggestions like passing a resolution to declare an invasion or defunding "radical courts." DeSantis’s proposal took things a step further, aiming to bypass the courts altogether.
Meanwhile, Trump has also been vocal about his frustrations with the judiciary. In a Truth Social post on Tuesday, he called for the impeachment of Judge James E. Boasberg of the U.S. District Court for the District of Columbia, whom he labeled a "Radical Left Lunatic" and an "agitator." Trump’s fiery rhetoric included calls to remove judges he deems biased, but Chief Justice John Roberts was quick to respond. Roberts issued a statement reminding everyone that "impeachment is not an appropriate response to disagreement concerning a judicial decision," adding that the appellate process exists for such disputes.
Rep. Brandon Gill of Texas announced that he had introduced articles of impeachment against Judge Boasberg, backing Trump’s demands. However, this move is likely to face significant resistance, as impeachment is a high bar to clear, even in today’s polarized climate.
DeSantis’s jurisdiction-stripping suggestion is sure to spark debate. While it’s a bold play to address judicial roadblocks, critics are already questioning the precedent it could set for the separation of powers. One thing’s for sure: the conversation about the judiciary’s role in politics is far from over.
