The Biden administration’s proposal aimed to redefine sex in Title IX as “gender identity,” which would have given transgender athletes more rights to participate in girls’ and women’s sports. However, this revision was blocked by a federal judge in January, just before President Donald Trump returned to office.

According to several former officials, an internal debate simmered within the administration over whether the new Title IX protections should extend to sports. While some believed that access to bathrooms and sports teams should follow the same logic for trans students, Biden reportedly felt differently. He believed that sports—being competitive and zero-sum—posed unique challenges and that some transgender athletes could have an unfair physical advantage over women.

One former official told the press that Biden was especially concerned about the competition aspect of the issue. Despite these private reservations, the administration remained mostly silent until 2023, deliberately avoiding the subject during the lead-up to the 2022 midterm elections. That’s one way to keep the political waters calm—just don’t stir them.

Recent polls indicate that about 80% of Americans share Biden’s reported stance on this contentious issue.

Title IX, enacted in 1972, prohibits sex-based discrimination in educational programs receiving federal funding. Its language is clear: “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”

Since taking office again, President Trump has signed an executive order barring transgender athletes from competing against biological girls in sports. Not all states are on board—Maine, for example, defied the order, leading to a freeze in federal funding. The drama between state and federal policies continues, and it’s clear the debate over fairness in sports isn’t leaving the national stage anytime soon.
