Senate Democrats are under fire after the Protection of Women and Girls in Sports Act failed to clear a filibuster in a Monday vote. The bill, which sought to define gender strictly based on biological sex for sports eligibility, managed only 51 votes, falling short of the 60 needed to advance. Unsurprisingly, no Democrats sided with Republicans on the bill.

The legislation, introduced by Sen. Tommy Tuberville, R-Ala., had over 40 Republican co-sponsors. It aimed to align Title IX with biological sex at birth and prevent federal funds from supporting states allowing transgender athletes to participate in women’s sports. Two House Democrats had crossed party lines to back the bill earlier this year, but the Senate vote showed no such bipartisan support. Adding to the drama, two Democrats and two Republicans were absent, resulting in a final tally of 51-45.

House Speaker Rep. Mike Johnson, R-La., didn’t hold back his criticism. "That is shocking. I cannot believe that the Democrats will not go along with common sense on this and the protection of women and girls," he said. Activists like Riley Gaines and Jennifer Sey also took to social media to voice their discontent.

The bill mirrored a recent executive order by former President Donald Trump, which seeks to prohibit biological males from competing in women’s sports by withholding federal funding from states that do not comply. The Tuberville bill was intended to codify this policy, extending its impact beyond the lifespan of an executive order.

Proponents of the legislation argue it’s about ensuring fairness in competitive sports and protecting opportunities for cisgender women and girls. Critics, however, see it as discriminatory against transgender athletes and a political maneuver designed to stoke division.

This vote marks another flashpoint in the ongoing debate over transgender rights and sports inclusion. With emotions running high on both sides, one thing is clear: this issue isn’t going away anytime soon.
