Craig Trainor, acting assistant secretary for civil rights at the Department, didn’t mince words, criticizing the Biden administration for allowing what he called Northern Virginia’s risky dabble in 'radical gender ideology.' The proposed resolution agreement demands that these districts scrap current policies, enforce sex-based separations in intimate facilities, and adopt biology-based definitions for 'male' and 'female' in all regulations. Failure to comply could lead to a referral to the Department of Justice.

Advocates like Sarah Parshall Perry from Defending Education hailed the move as a long-overdue return to the original intent of Title IX, which was designed to ensure educational equality for women. The districts, while acknowledging the federal directive, are reviewing their options, balancing legal compliance with their commitment to inclusive environments.

This clash highlights a broader national debate over balancing civil rights with personal privacy and safety in schools. With the clock ticking, the next ten days could set a significant precedent for how such policies are handled across the country.
