XX-XY Athletics Sues Colorado Over Free Speech Clash in Women’s Sports

Denver, CO - XX-XY Athletics, a bold women’s sportswear brand, has filed a lawsuit against Colorado, claiming a new state law stifles its free speech and marketing mojo. The legislation, HB25-1312, tweaks the Colorado Anti-Discrimination Act, defining 'gender expression' to include 'chosen name' and how folks want to be addressed. It mandates non-discriminatory access to public accommodations and advertising, but XX-XY argues it gags their mission to champion biological reality in sports.

The brand, led by firebrand founder Jennifer Sey, says the law bans them from using 'biologically accurate language' in their edgy ad campaigns, which often call out transgender athletes in women’s sports. 'This law forces us to twist our message or face hefty fines and legal headaches,' Sey told WTFNewsRoom. 'We’re fighting for every Coloradan’s right to speak truth without fear.'

Meanwhile, Colorado’s School District 49 in El Paso County is also suing the state over policies allowing transgender athletes in girls’ sports, citing conflicts with Title IX. 'The state’s pushing equity with one hand and discrimination with the other,' said Superintendent Peter Hilts. 'We’re seeking a legal fix to this mess.' Colorado’s Attorney General Philip J. Weiser has stayed mum on both lawsuits.
