These NDAs, also established in New Mexico and near El Paso, signal a seismic shift from the days when troops were limited to logistical tasks like surveillance or road-building. Now, soldiers can apprehend, search, and detain migrants until Border Patrol steps in, and migrants crossing these zones could face trespassing charges on military turf. The Pentagon’s Joint Task Force – Southern Border is flexing high-tech muscle, deploying Stryker vehicles, ground radar, and even 3D-printed drones to tighten surveillance.
Pentagon spokesperson Sean Parnell boasted zero ‘gotaways’—migrants evading capture—from June 28-30, crediting seamless coordination with Customs and Border Protection. But not everyone’s cheering. Civil liberties groups, like the Brennan Center for Justice, warn this blurs the line between military and police roles, potentially sidestepping the Posse Comitatus Act, which bars federal troops from domestic policing without Congress’ nod. Critics fear this could normalize military overreach far beyond the border.
Yet, supporters like former Arizona Supreme Court Justice Andy Gould call it a legal masterstroke against cartels, arguing Trump’s emergency declaration and military-purpose loophole hold firm. With troop numbers ballooning from 2,000 to over 8,000, and naval vessels now tackling maritime drug smuggling, the administration’s betting big on a militarized border. But as drug traffickers pivot to sea routes and critics sound alarms, one thing’s clear: the border’s becoming a battleground, and the stakes are sky-high.
